The terms that apply when you use this website, request a quote, and rent a dumpster from Tart's Dumpster Service.

Welcome to Tart's Dumpster Service ("Tart's," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your use of this website and the roll-off dumpster rental and hauling services we provide across Hardy, Grant, Hampshire, and Mineral counties, West Virginia. By using this website, contacting us, or renting from us, you agree to these Terms. If you do not agree, please do not use this website or our services.
1. Website use
You may use this website for lawful purposes only, to learn about our services and to contact us. Unless stated otherwise, the content on this site — including text, graphics, logos, and images — is the property of Tart's Dumpster Service or its licensors and is protected by applicable intellectual property laws. We work to keep the information here accurate, but service descriptions and any figures shown are for general information and do not constitute a binding quote.
2. Quotes and pricing
Most rentals begin with a quote based on the dumpster size, materials, delivery location, and rental period. Our pricing is all-in, and we disclose it up front. Each container includes one ton of weight; loads that exceed the included weight, contain prohibited materials, or require an extended rental period may incur additional charges, which we will explain before they apply.
3. Prohibited materials
For safety and legal compliance, certain materials may not be placed in our dumpsters, including but not limited to hazardous waste, paints and chemicals, motor oil and fuels, asbestos, tires, batteries, and appliances containing freon. Concrete and masonry require a dedicated load arranged by call. You are responsible for the contents of the container; prohibited materials found in a load may result in additional fees or refusal of disposal.
4. Delivery, placement, and pickup
You are responsible for providing a safe, accessible, and legal placement location and for any permits your municipality or HOA may require. Same-day delivery may be available when you call before noon, subject to availability. You agree that the placement surface may be subject to normal wear from the container and truck, and you are responsible for confirming that the location can bear the weight.
5. Payment
Payment terms are as stated in your quote or invoice. Unless agreed otherwise, payment is due as arranged at the time of service.
6. Text messaging (SMS) terms
Tart's Dumpster Service offers text messaging so customers and prospective customers can reach us and receive service updates about their dumpster rental. When you opt in — by submitting our online form with the messaging consent box checked, by texting us at (304) 944-6001, or by asking us to text you — you consent to receive text messages from us at the mobile number you provide, and the following terms apply:
- Program & message types. We send conversational and service messages: quote follow-ups, scheduling and delivery coordination, delivery and pickup confirmations, appointment reminders, and replies to questions you send us. We do not send recurring marketing or promotional text blasts.
- Consent is optional. Consent to receive text messages is not a condition of purchasing any goods or services.
- Message frequency. Message frequency varies and depends on your conversation with us and your active or upcoming rentals.
- Message & data rates. Message and data rates may apply, depending on your mobile carrier and plan. Tart's Dumpster Service is not responsible for charges from your carrier.
- How to opt out. You can cancel at any time by replying STOP to any message. After you reply STOP, we will send one confirmation and then stop texting that number. Reply START to opt back in.
- Help & support. Reply HELP to any message, or contact us at (304) 944-6001 or tartsdumpster@gmail.com.
- Carriers. Carriers are not liable for delayed or undelivered messages.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Your text-messaging consent and the mobile information you share with us are handled as described in our Privacy Policy.
7. Disclaimers
This website is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, secure, or error-free.
8. Limitation of liability
To the fullest extent permitted by law, Tart's Dumpster Service will not be liable for any indirect, incidental, or consequential damages arising out of your use of this website. Nothing in these Terms limits any liability that cannot be limited under applicable law. Our services themselves are governed by the quote or agreement for your specific rental.
9. Governing law
These Terms are governed by the laws of the State of West Virginia, without regard to its conflict-of-law rules. Any dispute relating to this website or these Terms will be handled in the state or federal courts located in West Virginia.
10. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on this page, with the "Last updated" date revised accordingly. Your continued use of the website or our services after changes are posted means you accept the updated Terms.
